Copyright Policy

Last updated: October 2026

Seedrate respects the intellectual property of others and expects users to do the same. This page explains how to report content on Seedrate that you believe infringes your copyright, what we do with a report, and how a user can respond if their content was removed. It is part of our Terms of Service.

If you own a copyright, or are authorized to act for the owner, and believe that content on Seedrate infringes it, send a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent:

Copyright Agent, Vida Technology, LLC d/b/a Seedrate

2401 Valley View Dr., Denver, CO 80221

Phone: 720-984-2802

Email: copyright@seedrate.com

Email is fastest. For your notice to be valid under the DMCA (17 U.S.C. § 512(c)(3)), it must include:

1. Identification of the copyrighted work you believe has been infringed (or a representative list if there are several).

2. Identification of the material on Seedrate that you believe is infringing, with enough detail for us to find it: the web address of the page and, where relevant, which photo or text on it.

3. Your name, mailing address, telephone number and email address.

4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.

5. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

6. Your physical or electronic signature.

Notices missing any of these may not be acted on; we will tell you what is missing.

What we do with a notice

When we receive a valid notice, we promptly remove or disable access to the material and notify the user who posted it, including a copy of your notice. We keep a record of the notice. If the material was uploaded by Seedrate itself rather than by a user, for example a seed packet image used for identification, we remove it on request without any of the formalities above: email copyright@seedrate.com with the page address.

Counter-notice

If your content was removed because of a notice and you believe the removal was a mistake or a misidentification, you may send a counter-notice to the same agent. Under 17 U.S.C. § 512(g)(3) it must include:

1. Identification of the material that was removed and where it appeared before removal.

2. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.

3. Your name, address and telephone number; a statement that you consent to the jurisdiction of the federal district court for the district in which your address is located (or, if your address is outside the United States, any judicial district in which Seedrate may be found); and that you will accept service of process from the person who filed the original notice or their agent.

4. Your physical or electronic signature.

We will forward your counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action seeking to restrain you, we will restore the material in 10 to 14 business days after receiving your counter-notice.

Repeat infringers

We close the accounts of users who repeatedly infringe, and we may close an account after a single serious infringement. We keep a record of closed accounts so that they cannot be reopened under the same email address.

False notices

Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, is liable for damages, including costs and attorneys' fees, incurred by the other party or by Seedrate. If you are not sure whether a use is infringing, consider getting advice before filing.

Trademarks and other claims

This process is for copyright. For a trademark complaint, a claim that content about you is false or defamatory, or a privacy concern, email legal@seedrate.com with the page address and an explanation, and we will respond. Seed company names and packet images appear on Seedrate to identify the products gardeners are reviewing; Seedrate is not affiliated with or endorsed by any seed company unless a page says so.
